HSE seeking legal advice on file disclosure
The Health Service Executive has said it is seeking legal advice on how to disclose files in relation to children in its care without breaching data protection laws.
It comes as the Independent Review Group set up by the Minister for Children said it has not received a single file almost two months after being set up.
This statement by the HSE yesterday came just hours after Children's Minister Barry Andrews expressed frustration that information was not been passed on to the Independent Review group.
The group was established by the Minister two months ago to look into cases where children die while in State care.
Minister Andrews said that he was seeking legal advice on the issue.
The HSE claims it has been unable to disclose files in relation to children in its care because the Child Care Act prevents it from doing so.
However, it says it is seeking to cooperate fully with the Review Group.
The HSE said it is now seeking legal advice on how to disclose files without breaching child care and data protection laws.
