TDs lose Boundary Commission case

The High Court today dismissed a legal challenge to the constituency boundaries on which the general election was fought.

The High Court today dismissed a legal challenge to the constituency boundaries on which the general election was fought.

Independent Deputy Finian McGrath and former TD Catherine Murphy have lost a case that constituency boundaries should have been drawn up based on 2006 census figures, to take account of changing demographics.

In a one hour and 20 minute judgement, Mr Justice Clarke dismissed the challenge.

The judge said the Oireachtas was not in breach of the constitution by not enacting boundary changes based on the census figures, but that such a time delay should not happen again.

He said preliminary figures were likely to be very similar final figures, and recommended that in future the minimum time should be taken to address required changes to constituency boundaries.

It is claimed current electoral boundaries could have cost some TDs their seats and may have affected the make up of the new Dáil.

Catherine Murphy, Finian McGrath, and Solicitor Edward McGarr for the candidates talk following the dismissal a legal challenge to the constituency boundaries on which the general election was fought.
