This baseball fan is suing ESPN and Major League Baseball after falling asleep at a game.

The fan was at a baseball game between his team - the New York Yankees - and the Boston Red Sox in April.

He fell asleep and was picked out by the cameras during the fourth inning.

ESPN announcers John Kruk and Dan Shulman, who are also included in the lawsuit, engaged in some easy-going banter about him, wondering how long he had slept for and if he was comfortable.

The fan, 26-year-old Andrew Rector, has filed a complaint with the State Supreme Court in the Bronx.

In it the comments of Kruk and Shulman are described as “an unending verbal tirade”.

Rector claims the initial broadcast and online comments that followed caused him “emotional distress”.

He is suing ESPN, MLB, the New York Yankees and the two commentators for what is reportedly seeking $10m in damages.
