A 16-year-old boy charged over a fatal collision in which a Deliveroo cyclist was killed in Dublin has been remanded in custody again after his bail was revoked.

Thiago Osorio Cortes (28) from Rio de Janeiro, in Brazil, was cycling on North Wall Quay in Dublin when he was struck by a car at about 10.30pm on August 31st last. The student was delivering food for Deliveroo at the time of the collision.

He was taken by ambulance to the Mater Hospital where he was later pronounced dead.

Remanded in custody

A teenage boy was remanded in custody on November 7th after he was charged with dangerous driving causing death of Mr Cortes and failing to report the occurrence of an injury to gardaí. He made a successful bail application in the High Court later and had been released.

However, gardaí successfully applied for it to be revoked last Friday, and he appeared again at the Children’s Court on Tuesday.

Detective Sergeant John Brady applied for an adjournment to obtain directions from the DPP. He said an extensive file has been sent to the DPP with 244 statements and 149 CCTV clips. Defence solicitor Aoife McNicholl asked the court to note the boy, who was accompanied to court by his mother, was now in custody again and his situation was different now.

If the case was put back to January 5th, the date sought by Detective Sergeant Brady, she asked that the directions would have to be available then. Judge Treasa Kelly refused to order that, but she said the matter must be expedited.

No indication on plea

The teenager would not consent to a three-week adjournment and was remanded in custody to appear again next Tuesday. Earlier his solicitor had said it was likely the case will go to the Circuit Court.

The boy has not yet indicated how he will plead. He cannot be named because he is a minor. Section 93 of the Children Act states that no report shall be published or included in a broadcast which reveals the name, address or school of any child concerned in the proceedings or includes any particulars likely to lead to the identification of any child concerned in the proceedings.

Mr Cortes has lived in Dublin with his fiancée Theresa Dantas for two years and was studying English. It is understood that he was saving money to study a master’s in business at the time of his death.
