O'Toole guilty of arson, but no verdict on capital murder

A Dublin man has been convicted by a jury on a charge of arson in a trial relating to the death of a Garda Sergeant in Tallaght in July 1999.

A Dublin man has been convicted by a jury on a charge of arson in a trial relating to the death of a Garda Sergeant in Tallaght in July 1999.

Daniel O'Toole of Cashel Avenue, Crumlin, denied charges of capital murder, murder and arson and pleaded guilty to manslaughter.

However, the foreperson of the jury has told the court that they have not reached a verdict on the charges of capital murder and murder, and has said that no matter how long they stay out, they will not reach a majority.

The presiding judge said that the consequences of a retrial are appalling and appealed to the jury to think about the matter.

The jury is set to return again at 2.15pm.
