Retrial ordered in assault case

The jury in the trial of a Dublin accountant accused of assaulting a former Ericsson engineer leaving him blind in one eye has been discharged having failed to reach a verdict.

Brian Keane (aged 28) of Glenlyon Park, Knocklyon, had pleaded not guilty at Dublin Circuit Criminal Court to assaulting Mr Jairo Andreas Diaz (aged 33) causing him harm by forcing him through a glass door at a Good Friday party at Richelieu Park, Sandyford between April 14 and 15, 2006.

The jury of nine men and three women had been deliberating for almost six and a half hours on day six of the trial when the foreman indicated that the members could not agree on a verdict.

Judge Tony Hunt thanked the jury for their time and attention during the trial before he excused them from service for seven years.

He remanded Mr Keane on continuing bail to later this month when a date will be set for his retrial.
