Air Corps officer wins appeal against dismissal
An Air Corps officer who was dismissed from the Defence Forces for verbally abusing his superior has won an appeal against his dismissal.
Commandant Nile Donohoe was the first officer to be dismissed in more than 20 years after a court martial found him guilty of using threatening or insulting language to a superior officer.
The father-of-two was attached to the No. 5 Support Wing in Baldonnel, in Dublin at the time of the incident on January 30, 2009
It was claimed the decorated officer insulted Lt Col Gerry O'Sullivan after receiving an appraisal of his performance but he insisted that what he had actually said was that the appraisal was "a little prickly".
The court martial described it as a calculated insult and ''a gross breach of military discipline''.
However he was reinstated pending an appeal.
Today the court has found that the administrator in charge of selecting the court martial board that convicted him overstepped his powers during this process.
His conviction has now been quashed.
