The family of bankrupt businessman Sean Quinn will today take steps to keep alive their multimillion euro legal action against the former Anglo Irish Bank.

The family of bankrupt businessman Sean Quinn will today take steps to keep alive their multimillion euro legal action against the former Anglo Irish Bank.

They will ask the High Court to overturn a stay on all lawsuits against the bank brought in by the emergency IBRC Act last month.

Sean's wife Patricia Quinn and their five children Collette, Ciara, Aoife, Sean and Brenda are challenging the legality of €2.3bn of loans issued to Quinn businesses by the former Anglo Irish Bank.

However when the Oireachtas rushed through legislation liquidating IBRC last month, one of the repercussions of the new legislation was that it put a halt to all existing legal actions against the bank.

The Quinns are today applying for this statutory stay to be lifted so they can press on with their case and IBRC's liquidators are unlikely to object as it is their understanding the stay is meant to be temporary.

The court will have to consider whether the act allows a judge to interfere - the ruling will have repercussions for many other cases against the bank.
